Terms of Sale and Use

We are not currently taking payments. The online assessment and the PDF report are both free. Sections 3 to 6, and the terms on paid reports in sections 8 and 9, apply only to reports bought before payments were paused. The rest of these terms apply to everyone who uses CanUBuild.

1. Who we are

CanUBuild is a UK-based online planning-feasibility service. In these terms, “CanUBuild”, “we”, “us” and “our” mean the operator of the CanUBuild service.

2. What CanUBuild supplies

CanUBuild supplies automated planning-feasibility information generated from your project inputs and available planning and constraint data. The complete online assessment is free, including supporting factors, available nearby precedent and mapped constraints. A formatted PDF copy for the property and project assessed is currently free to download.

A report is digital content and guidance only. It is not a planning decision, lawful development certificate, planning application, architectural design, legal opinion or advice from a chartered town planner. Unless an offer expressly says otherwise, no human planner reviews the report.

3. Orders, price and contract

  • The total one-off price is shown before you pay. A report purchase is not a subscription and does not create recurring charges.
  • You must check the property and project details before paying. The report is prepared for that property and project only.
  • Your order is accepted, and a contract is formed, when Stripe confirms successful payment and we make the paid report available.
  • If we cannot accept or fulfil an order, we will tell you and refund any amount taken.

4. Immediate digital supply and cancellation

Consumers normally have 14 days to cancel a distance contract. Because the report is digital content intended for immediate delivery, checkout asks you to expressly consent to supply beginning before that period ends and to acknowledge that your statutory cancellation right is lost once supply begins. We record that consent with the order. If you do not give it, you cannot complete immediate report checkout.

This does not affect your rights where digital content is faulty, not as described or not supplied with reasonable care and skill.

5. Delivery and guest accounts

We aim to make the PDF download available immediately after payment and send a copy or access link to the email used at checkout. Delivery can occasionally be delayed by payment-provider, data, hosting or email issues. If your report has not arrived within a reasonable time, contact us with the payment reference.

If you buy as a guest, we create a CanUBuild account using the checkout email and send a secure password-setup link with the report. You are responsible for keeping that account secure.

6. Refund policy

We do not normally refund a change-of-mind request after immediate digital supply has begun with your express consent and acknowledgement. We will, however, refund duplicate payments, an order we cannot deliver, or another amount that you are legally entitled to recover.

If the report is faulty or materially different from its description, contact us with the order email and explain the problem. Where required by law, we will repair or replace the digital content within a reasonable time and without significant inconvenience. If that is impossible or unsuccessful, you may be entitled to an appropriate price reduction, potentially up to a full refund. Agreed refunds are made without undue delay and normally to the original payment method.

7. Data, judgements and your responsibilities

Planning applications and constraint datasets are supplied by public and third-party sources. They can be incomplete, delayed, incorrectly mapped or unavailable. We show available coverage and freshness indicators, but we cannot guarantee that every relevant designation, decision, policy or site-specific fact is present.

Planning outlooks are qualitative, rule-based judgements, not statistical probabilities or guarantees. You remain responsible for checking the report and project facts, consulting the relevant local planning authority, and obtaining all necessary permissions, certificates, consents and professional advice before starting work or committing significant expenditure.

8. Our responsibility to you

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If we breach these terms, we are responsible for loss or damage that was a foreseeable result when the contract was made. We are not responsible for loss caused by inaccurate information you provide, your failure to verify an automated result, changes made after the report date, or events outside our reasonable control. To the fullest extent permitted by law, our total liability arising from a paid report is limited to the price paid for that report. We do not exclude liability that cannot legally be limited.

If you use CanUBuild wholly or mainly for business purposes, we are not liable for loss of profit, revenue, business, anticipated savings, goodwill or indirect loss.

9. Intellectual property and acceptable use

We grant you a personal, non-exclusive licence to use and share your purchased report for the property and project assessed. CanUBuild software, branding, report design and original content remain ours or our licensors'. You must not resell reports, systematically scrape the service, bypass access controls, disrupt the site or use it unlawfully.

10. Privacy

Our Privacy Policy explains how we use personal information, including checkout details, account information, addresses and project inputs.

11. Changes to these terms

The version presented when you order applies to that purchase. We may update these terms for future use, for example when the service or law changes. An update does not retrospectively remove rights you already have.

12. Governing law and complaints

Please contact enquiries@canubuild.co.uk first so we can try to resolve any complaint. These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you keep any mandatory protections provided by the law where you live and may bring proceedings in the courts available to you under applicable consumer law. Otherwise, the courts of England and Wales have jurisdiction.
